1. INTRODUCTION AND ACCEPTANCE OF TERMS

Welcome to My Dincharya (“My Dincharya,” “Company,” “we,” “us,” or “our“). These Terms and Conditions (“Terms“) constitute a legally binding agreement between you (“User,” “you,” or “your“) and My Dincharya governing your access to and use of the website located at https://mydincharya.com, including all related subdomains, mobile applications, digital tools, downloadable content, e-commerce features, community forums, and any other services we may offer now or in the future (collectively, the “Platform” or “Services“).

By accessing, browsing, registering on, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules posted on the Platform, all of which are incorporated herein by reference. If you do not agree to these Terms in full, you must immediately discontinue use of the Platform.

If you are using the Platform on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. ELIGIBILITY

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Platform. By using the Platform, you represent and warrant that:

3.2 Future and Expanding Offerings

You acknowledge and agree that My Dincharya may, without prior notice, expand its Scope to include:

• Proprietary digital tools, calculators, trackers, and applications
• Downloadable routines, templates, e-books, courses, and digital products
• E-commerce functionality, including the sale of physical or digital products
• Affiliate recommendation engines, curated marketplaces, and sponsored content
• Community features including forums, comment sections, user profiles, messaging, and social functionality
• Subscription-based membership tiers or premium content offerings
• Any other product, service, or feature reasonably related to health, wellness, productivity, or lifestyle optimization

These Terms shall automatically apply to any such expanded Services without requiring a separate agreement, unless we expressly state otherwise in supplemental terms applicable to a specific feature.

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership

All content on the Platform — including but not limited to text, articles, guides, protocols, frameworks, graphics, logos, icons, images, audio clips, video clips, data compilations, software, downloadable materials, page layouts, custom designs, and the overall “look and feel” of the Platform (collectively, “Content“) — is the exclusive property of My Dincharya or its licensors and is protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and other countries, as well as applicable international treaties.

4.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Content for your personal, non-commercial use only.

4.3 Prohibited Uses

You expressly agree that you shall NOT, without our prior written consent:

• Scrape, crawl, harvest, mine, or use any automated system or software to extract data or Content from the Platform;
• Republish, redistribute, mirror, or syndicate any Content on any other website, platform, or medium;
• Reproduce, duplicate, copy, sell, resell, license, sublicense, or commercially exploit any Content or portion thereof;

• Remove, obscure, or alter any copyright, trademark, or other proprietary notices;
• Use My Dincharya’s name, logo, trademarks, or branding without express written authorization.

4.4 Enforcement

Unauthorized use of any Content may result in civil and/or criminal penalties, and we reserve the right to pursue all available legal remedies, including injunctive relief and monetary damages, against violators in any competent jurisdiction.

4.5 User-Generated Content

If the Platform permits you to submit comments, reviews, posts, or other content (“User Content“), you grant My Dincharya a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such User Content in connection with the Platform and our business, in any media now known or hereafter developed. You represent that you own or have the necessary rights to grant this license and that your User Content does not infringe any third-party rights.

5. MEDICAL DISCLAIMER AND ASSUMPTION OF RISK

5.1 Not Medical Advice

THE CONTENT PROVIDED ON THE PLATFORM — INCLUDING ALL BIOHACKING GUIDES, SLEEP PROTOCOLS, PRODUCTIVITY FRAMEWORKS, PRODUCT REVIEWS, AND RELATED MATERIAL — IS PROVIDED FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. It does not constitute, and should not be relied upon as, medical, health, psychological, nutritional, or professional advice of any kind. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OR IMPLEMENTATION OF ANY GUIDE, PROTOCOL, RECOMMENDATION, DEVICE, OR PRODUCT REFERENCED ON THE PLATFORM IS ENTIRELY AT YOUR OWN RISK. 8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY DINCHARYA, ITS OWNERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, goodwill, personal injury, or health outcomes, arising out of or related to your use of, or inability to use, the Platform, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

8.3 Liability Cap

WHERE LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MY DINCHARYA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

8.4 Jurisdictional Variations

Some jurisdictions (including certain EU member states, the UK, and parts of Australia and Canada) do not permit the exclusion or limitation of certain warranties or liabilities, including liability for death, personal injury caused by negligence, or fraud. In such jurisdictions, our liability is limited to the fullest extent permitted by the applicable law of that jurisdiction, and nothing in these Terms shall be construed to exclude or limit liability that cannot lawfully be excluded.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless My Dincharya and its owners, officers, employees, contractors, licensors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) your implementation of any Content, guide, or protocol found on the Platform.

10. USER CONDUCT

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms;
• Harass, abuse, threaten, defame, or impersonate any person or entity, including our staff, other users, or community members;

• Circumvent, disable, or otherwise interfere with security-related features of the Platform.

10.1 Termination of Access

We reserve the right, at our sole and absolute discretion and without prior notice, to suspend, restrict, or permanently terminate your access to the Platform — including any account, community privileges, or purchased content — if we believe, in good faith, that you have violated these Terms, engaged in abusive or harmful conduct, or acted in a manner that poses risk to the Platform, its users, or My Dincharya’s reputation. No refund shall be owed for any termination resulting from a violation of these Terms, except where required by applicable law.

11. PRIVACY

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR) for EU/UK users, the California Consumer Privacy Act (CCPA) where applicable, and other relevant frameworks in Canada and Australia. 12. MODIFICATIONS TO THE TERMS

We reserve the right to update, amend, or modify these Terms at any time, at our sole discretion, without providing prior individual notice to users. Your continued access to or use of the Platform following the posting of revised Terms constitutes your binding acceptance of such changes. 13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which My Dincharya is legally established and operated, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence (such as those of the EU, UK, Canada, or Australia) grant you additional non-waivable rights, in which case such local mandatory provisions shall apply to the extent required.

13.2 Informal Resolution

Before initiating any formal dispute proceedings, you agree to first contact us at contact@mydincharya.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally within thirty (30) days of receiving notice.

13.3 Arbitration and Dispute Resolution

Where permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court where jurisdictionally appropriate. YOU AND MY DINCHARYA EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING, to the fullest extent permitted by applicable law. For users in jurisdictions where mandatory arbitration of consumer disputes is not enforceable (including certain EU member states), disputes shall instead be subject to the exclusive jurisdiction of the competent courts as determined by applicable local consumer protection law.

13.4 EU/UK/Australia Consumer Rights

Nothing in this Section 13 is intended to limit any non-waivable statutory rights you may have as a consumer under the laws of the European Union, United Kingdom, Australia, or Canada, including your right to bring proceedings in the courts of your country of habitual residence where mandated by local law.

14. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.

15. NO WAIVER

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of My Dincharya to be effective.

16. ASSIGNMENT

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other legal notices or supplemental terms published by us on the Platform, constitute the entire agreement between you and My Dincharya regarding your use of the Platform, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
